A Republican federal judge appointed by President George W. Bush just ruled against the Trump administration ending DACA.
Here are the details…
From The Hill:
A federal judge on Tuesday ordered the Trump administration to continue accepting Deferred Action for Childhood Arrivals (DACA) applications, dealing a major blow to the administration as it attempts to wind down the program.
U.S. District Judge John Bates, a George W. Bush appointee, became the third federal judge to reject President Trump’s explanation for ending the program, ruling that the decision by the Justice Department that the program was unlawful was “virtually unexplained.”
Trump rescinded DACA in September, giving Congress six months to pass legislation in its place.
More from USA Today:
In a scathing 60-page ruling, Judge John Bates of the U.S. District Court for the District of Columbiawrote that administration moves to cancel DACA were “arbitrary” and “capricious” because DHS “failed adequately to explain its conclusion the program was unlawful.”
The court gave the Trump administration 90 days to challenge the ruling before reinstating DACA in its entirety.
The dispute dates back to 2012, when then-president Barack Obama established the program without congressional action. The goal was to protect from deportation undocumented immigrants who were brought to the country as children, but many Republicans called it executive overreach and have remained opposed to the program.
Right Scoop delivers the final blow:
That means that the administration has to not only continue the program for illegals already enrolled in it, but he has to KEEP allowing illegals to apply!! Absurd….
DACA was unconstitutional to begin with.
It’s time these judges do the right thing and enforce the laws on the books!
